  • Attendance tracking and reporting
  • Parent-school communication tools
  • Security and audit logging

3. User Accounts and Eligibility

3.1 Account Types

  • School Administrators: Must be authorized representatives of educational institutions
  • Parents/Guardians: Must be legal guardians of enrolled students
  • School Staff: Must be employed by participating schools

3.2 Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that:

  • All information you provide is accurate and current
  • You have the legal authority to use the Service
  • You will maintain the security of your account credentials
  • You will promptly update any changes to your information

4. User Responsibilities

4.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and enabling two-factor authentication

4.2 Prohibited Activities

You agree NOT to:

  • Provide false or misleading information

  • Share your pickup codes with unauthorized individuals
  • Attempt to gain unauthorized access to the Service
  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission

5. School Responsibilities

Schools using Ward Guard agree to:

  • Obtain proper parental consent before enrolling students
  • Verify the identity of authorized pickup persons
  • Train staff on proper use of the Service
  • Maintain accurate student and parent information
  • Follow their own policies regarding student release
  • Report any security incidents or concerns promptly

6. Intellectual Property

6.1 Our Rights

Ward Guard and its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our software or content
  • Use our trademarks without permission
  • Create derivative works based on our Service

6.2 Your Content

You retain ownership of content you upload (photos, information). By using the Service, you grant us a limited license to use, store, and process this content solely to provide the Service.

7. Payment Terms

For schools subscribing to paid plans:

  • Fees are billed in advance on a subscription basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • Failure to pay may result in service suspension
  • You are responsible for all applicable taxes

8. Service Availability

We strive to provide reliable service but cannot guarantee:

  • Uninterrupted or error-free operation
  • That defects will be corrected immediately
  • That the Service will meet all your requirements

We may modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Ward Guard is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees paid by you in the past 12 months
  • We are not responsible for actions taken by schools or parents using the Service

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Ward Guard from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Termination

11.1 By You

You may terminate your account at any time by contacting us or through your account settings.

11.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees
  • Pose a security risk to the Service or other users

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally.

  • Waiver: Failure to enforce any right does not waive that right

  • Force Majeure: We are not liable for delays due to circumstances beyond our control
